JKA Karate East Lothian and JKA Karate Dalgety Bay are both organisations associated with Sensei Bert Stewart, who operates as a sole trader. Please note that we have described items as accurately as we can, and have provided images which have not been manipulated to help you make your choices. On occasion, information such as prices, product descriptions, stock quantities may not be up to date and could change without notice.
We make all reasonable efforts to accurately display the attributes of our products, including the colours, but please note that the colour you see on your device screen may not match the actual colour of the item. How your device shows colours is outwith our control
2. If you are unhappy with your purchase
Please discuss the matter with Sensei Bert Stewart immediately. We are a small members organisation and respect each other. If there is a concern, you should feel encouraged to raise it and Sensei Bert Stewart will try and find a solution. This does not mean however that Sensei Bert is obliged to make a refund, particularly where there is clear evidence that the equipment has been used or worn.
We will abide by the UK’s Consumer Contracts Regulations 2013. This states customers have the right to cancel their online order until 14 days after they receive their goods.
If you choose to return goods (in a condition where they can be sold again with no rework) , we will process your exchange or, if appropriate, refund within 14 days of the goods’ arrival with Sensei Bert Stewart. For more information, please see below.
3. Non-returnable items
For reasons of hygiene, it will not be possible to refund monies in connection with gumshields, groin guards or fist protectors. In the event of a dispute about the item’s quality, Sensei Bert Stewart will consider providing a replacement item or issue a credit note against a future purchase. You will surrender the item in question to Sensei Bert Stewart who will arrange its destruction.
4. Terms of Sale
By placing an order with us, you are offering to purchase a product, representing that you are of legal age to form a binding contract, and are representing that all information you provide to us in connection with such an offer to buy a product is true and accurate and that you are an authorised user of the payment method provided. The receipt by you of an order confirmation does not constitute our acceptance of an order. We retain the right to refuse any order request made by you.
We reserve the right at any time after the receipt of your order to accept or decline your order. It is possible that due to circumstances beyond our control, such as services provided by a third party, such as our embroiderer, we may have to ask you to modify your requirements. This will be done in discussion between you and Sensei Bert Stewart. If it is not possible to meet your requirements due to issues with third party suppliers, we will cancel your order and refund any monies transferred to us. No goods will be supplied without the receipt by Sensei Bert Stewart of the cleared funds from you to pay for the goods. No goods will be supplied on credit, or for approval.
In the event that an item lists an incorrect price, either due to typographical or other error, we shall have the right to refuse or cancel any such order regardless of whether the order is being or has been processed. If payment has already been made or if your account has already been charged for the purchase and the order is cancelled, we will refund you for the incorrect price either through a bank transfer or through the application of a credit to your account.
5. DELIVERY ARRANGEMENTS
Sensei Bert Stewart will dispatch the goods on receipt of cleared funds. We will accept payment through cheque, cash or through bank transfer to specified bank account. We do not accept PayPal or credit card payments at this time. No credit will be given.
If requested, delivery through Royal Mail postage can be provided. No guarantees can be given as the time taken taken to deliver your goods. Sensei Bert Stewart is not liable for any issues around the delivery of your goods. Sensei Bert Stewart will dispatch your goods as soon as reasonably practical after the receipt of the payment and will obtain proof of posting, which he will supply to you if required in the event of any dispute between you and the Royal Mail.
For some high value items, you may choose to make your own delivery arrangements, such as using a particular courier or organising a collection with Sensei Bert. In this case, please do not buy the item with postage, but instead choose it without postage. Communicate with Sensei Bert Stewart as to how you wish to arrange the pick up of the item. Sensei Bert Stewart will make reasonable efforts to co-operate with whatever pickup arrangements you wish to make yourself.
6.Intellectual Property Protection
All the content of JKA Karate East Lothian and JKA Karate Dalgety Bay dojos belongs to Sensei Bert Stewart and is protected by copyright law. Content is defined as all words, logos and images featured on these websites. The JKA logo is used in agreement with the Japan Karate Association as part of the affiliation arrangements in place. Nothing contained within either or both websites should be construed as granting any licence or the right to use trademarks without the prior written consent of Sensei Bert Stewart.
7. Disclaimer of liability
Sensei Bert Stewart supplies items associated with a martial art but takes no responsibility around their use. Martial arts involve an element of risk which you accept by taking part in organised activities such as online training. You are advised to conduct your own risk assessment of your surroundings when considering taking part in online training. You must ensure it is safe to proceed, and that you are taking account of any health issues you may suffer when deciding whether or not to take part, and monitoring your physical condition during a class is your responsibility. Parents or carers of members under 18 are responsible for ensuring they have a safe environment where they can take part in online training.
In the context of the JKA Karate East Lothian online store, neither Sensei Bert Stewart, nor anyone else or organisation involved in facilitating the online store will be responsible for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by the customer.
